The appeal lodged by Douala International Terminal (DIT) was rejected by the First Civil Chamber of the French Court of Cassation.

 

The verdict, handed down in a ruling signed on 19 June 2024, annulled the arbitral award made on 10 November 2020, which ordered the Port Authority of Douala (PAD) to pay the sum of 58.6 million euros as compensation for loss of opportunity in the tender for the renewal of the container terminal concession agreement for the port of Douala-Bonaberi with effect from 1 January 2020, on the grounds that the arbitral tribunal was not regularly constituted.

 

In a press release signed on 20 June 2024 by Mr. Raoul Simplice Minlo, Head of the Communication and Public Relations Division of the Port Authority of Douala, the Port Authority welcomes this new ruling, putting an end to speculations regarding the functioning of its Container Terminal.
